Chapter 7 bankruptcy: Also known as a liquidation of assets, in Chapter 7 bankruptcy you may fully discharge certain debts in exchange for the sale of some of your assets. Although some debts — such as taxes, student loans and child support — cannot be discharged, most debt is discharged when you file.
Chapter 13 bankruptcy: Sometimes called the wage earner's plan, Chapter 13 is an opportunity to restructure your debt. When you file, you agree to restructure your debt, repaying creditors over a period of three to five years. If you pay the debt according to the repayment plan, at the end of the agreement, your remaining debts will be discharged.
Repossession and foreclosure: If you are several months behind on your mortgage payments, and the bank is threatening to foreclose or repossess your home, it is important to work with an attorney who can help you understand your options.
